1. Definitions
Operator — the rights holder of the EMERLAND.PW portal, is a party to the User Agreement. The Operator administers and maintains, provides users with access to the portal, services (including paid services) under the terms of this agreement.
User — an individual visiting the portal or participating in projects of the EMERLAND.PW portal.
The User, as well as the Operator, are parties to the Agreement.
Portal — special software and hardware complexes located on the resources of the Operator. User access to the portal is provided only by the Operator. All rights to use this portal belong exclusively to the Operator.
Website — a site located on the Internet at the address https://EMERLAND.PW
Services — providing Users with access to the Portal, using opportunities and services, participating in projects on the terms defined by Agreements. Operator's Services are provided free of charge. Exceptions are only Additional Paid Services. All Services are provided by the operator only within the Portal, i.e. during its use by the User.
Additional Paid Services — providing the User with additional special Portal capabilities for a fee. These services are optional and provided at the request of the User. Paid Services are also provided by the Operator exclusively within the Portal.
2. Subject of the Agreement
2.1. The Operator provides access to the Portal (Services, Resources, Paid Services) to an unlimited number of persons, under the terms of this Agreement.
2.2. The User acknowledges that the main purpose of the projects on the EMERLAND.PW portal is to provide entertainment and leisure activities by the Operator, in no way associated with gambling activities.
3. Procedure for the Agreement to Enter into Force
3.1. From the moment of accepting this Agreement, the User has rights and fulfills obligations stipulated in the text of this Agreement.
3.2. The User accepts and agrees to the terms of this Agreement by registering on the website: EMERLAND.PW. The act of acceptance signifies the User's full and unconditional agreement with all the conditions and appendices of this Agreement.
3.3. If, for any reason, the User does not agree with the terms or appendices of this Agreement, they must cease further use of the Site.
3.4. The Site may only be used after the User accepts this Agreement.
3.5. By accepting this Agreement, the User confirms their legal capacity, the right to enter into this Agreement. The Operator is not obligated to verify the data provided by the User during registration.
3.6. If creating an account (hereinafter "Account") is necessary for using the information and entertainment portal EMERLAND.PW or participating in its projects, the User must go through the registration process, providing the Operator with current, complete, and accurate information (including email address) in the corresponding form. In case of posting messages on the EMERLAND.PW portal about participation in partner programs, the registered User has the right to participate in contests, giveaways, and competitions on the partners' sites EMERLAND.PW.
4. Rights and Obligations of the Parties
4.1. User Rights
In accordance with this Agreement, the User has the right to:
Use the Portal solely for personal, non-commercial purposes.
Utilize all services, resources (including Additional Paid Services) provided by the Operator.
If necessary, use technical support of the sites, address questions to the Operator through contact information or feedback form.
Use the site and participate in Portal projects free of charge (excluding the provision of Additional Paid Services).
4.2. User Obligations
In compliance with the terms of this Agreement, the User is obliged to:
Provide accurate information when registering on the Site.
Independently take all necessary measures to ensure effective security of their personal account. Do not grant access to third parties.
Upon request by the Operator, provide confirmation of their personal data provided on the Site during registration.
Follow the Operator's instructions within this Portal.
Do not violate the intellectual property rights of the Operator located on their Portal.
Comply with all unrestricted terms of this Agreement.
The User undertakes to use the Portal solely for entertainment purposes, without seeking to derive any benefit from the Portal.
4.3. User has no right
When using the Operator's Portal, the User is not entitled to:
Exploit site errors (bugs) and Portal services, gain unauthorized access to the general database, computer system, or modify the software code. Users are prohibited from using malicious programs capable of harming the Portal, as well as specialized software that gives them an advantage over other users. If such or similar violations are detected, the Operator has the right to apply punitive measures to the User, including restricting access to sites and deleting accounts.
Restrict access to other Users' sites.
Engage in fraud and other unlawful activities.
Advertise anything unrelated to the Portal without written permission from the Operator.
Use profanity, express threats against the Operator or other Users, spread materials promoting violence, racial hatred, religious intolerance, containing pornographic information, advertising drugs, or inciting violent overthrow of authority.
Conduct anti-advertising against the Portal, including outside its limits.
The User agrees that their rights and obligations may be amended/supplemented by the Operator, which they will be notified of via the contact information provided during registration (or on the Site).
4.4. Rights of the Operator
This Agreement grants the Operator the following rights:
At any time, at its discretion, unilaterally expand, modify, terminate, or limit the provision of Services, as well as Additional Paid Services, without prior notice to Users.
Manage all processes on the Portals solely at its discretion. Suspend, modify the course of any processes without prior notice to the User.
Apply sanctions to the User in case of violations of this Agreement.
Delete/modify User information posted on the Portals.
Track, store identification and statistical information about the User.
Send Users technical, promotional, and other information related to the Portal, Services, and Paid Services.
Inform, warn, make remarks, notify the User in case of non-compliance/violation of the terms of this Agreement. All instructions of the Operator must be strictly followed.
Take lawful measures to protect its intellectual and copyright property.
Modify, change, supplement the Portal at its discretion without prior notice to the User.
Operator's inaction on User violations of this Agreement does not exclude subsequent punitive sanctions.
4.5. Obligations of the Operator
As a party to the User Agreement, the Operator is obliged to:
Ensure the User's ability to receive Operator Services within this Portal (including obtaining Additional Paid services).
Respond to User inquiries, take all necessary measures to resolve disputes when they arise.

1. Definitions

4. Rights and Obligations of the Parties

4.3. User has no right

4.5. Obligations of the Operator
As a party to the User Agreement, the Operator is obliged to:
Ensure the User's ability to receive Operator Services within this Portal (including obtaining Additional Paid services).
Respond to User inquiries, take all necessary measures to resolve disputes when they arise.
4.6. Limitation of Operator's Liability
In accordance with this section, the Operator is not liable for:
Any damage caused or that may only be caused to the User's personal data and computer in connection with the use of the Portal and Site.
Losses (direct/indirect) incurred by the User in connection with the use or unavailability of the Portal (inability to use them), the behavior of third parties on the Portal, as well as other participants in the Portal's projects, unauthorized access to the User's personal data.
Statements, disseminated information, statements by the User, and other unlawful actions committed by them on the Portal and beyond.
The User-provided information at registration, loss of access to the Portal (login, password, etc.).
Loss by the User of virtual assets acquired as a result of the provision of Services and Additional Paid Services by the Operator.
Payment by the User of Additional Paid Services and related expenses.
Continuous operation of the Portal.
User's capabilities related to Internet access, data transfer speed.
4.7. Operator does not guarantee:
Continuous, reliable, error-free operation of the Portal, access to its resources, Services, including Additional Paid Services.
That the Portal will fully meet the User's requirements and expectations.
That the quality of the Services provided (Additional Paid Services) will meet the User's expectations.
The Operator is not obliged, upon the User's request, to provide documents and other evidence proving the User's violation of this Agreement and the imposition of punitive/disciplinary sanctions against them.
The User uses the Portal, the Operator's Site solely at their own risk, voluntarily, without coercion. They understand the potential risks associated with using the Operator's resources and have no claims of a material nature against the Operator.
5. Confidentiality and Security
5.1. Confidential information - information obtained by the Operator during the User's registration on the Site, as well as during visits to the Sites/Portal and participation in Portal events.
5.2. Confidential information is not subject to disclosure or transfer to third parties.
5.3. Personal data may be transferred by the Operator only in the following cases:
Official request from law enforcement authorities (violation of local and international laws).
User's personal expression of will.
Impossibility to use Services and Additional Paid Services on the Portals (of which the User is warned in advance).
Violation of the terms of this Agreement (at the discretion of the Operator).
5.4. The Operator ensures the security of the user's personal data using special software. In case of unauthorized access to the Portal/Site by third parties, the security of personal data is not guaranteed.
6. Additional Paid Services
6.1. At the request of the User, the operator provides Additional Paid Services. These allow the use of extended features of the Portal.
6.2. Additional Paid Services are not a mandatory condition for using the Portal and participating in the Portal projects.
6.3. From the moment the funds are debited by the Portal Operator from the User's account, the Additional Paid Service is considered to be provided in full and of proper quality.
6.4. After the provision of an Additional Paid Service, the money spent on its purchase is not refundable.
6.5. The User agrees that the Operator has the right to store personal information received when purchasing Additional Paid Services.
6.6. The list of Additional Paid Services and their cost are published only by the Operator on the Site/Portal. Any information and offers to purchase these services on third-party resources are considered fraudulent, for which the Operator is not responsible.
6.7. The methods and possibility of purchasing Additional Paid Services are explained by the Operator on the Site.
6.8. The Operator does not provide explanations on working with payment systems that the User decided to use to purchase Additional Paid Services, nor is it responsible for their correct operation.
6.9. In the case of technical malfunction of the Sites or intentional actions by the User, as well as in other cases when Additional Paid Services were provided without full/partial debiting of funds from the User's account, the User is obliged to inform the Operator about this fact. After that, the User must repay the resulting debt.
6.10. The Operator does not reimburse the User for unused (partially used) Additional Paid Services.
6.11. The User independently bears all financial expenses associated with the acquisition (transfer of money) of Additional Paid Services. This section includes: commissions, fees, and other expenses.
6.12. The User guarantees to the Operator that they have all legal powers and rights to conclude this Agreement regarding Additional Paid Services.
6.13. If Additional Paid Services are purchased by a User under the age of 18, they must first obtain consent for the financial transaction from their legal representatives. The fact of purchasing Additional Paid Services confirms that such consent has been obtained from the legal representative. If necessary, the Operator has the right to request written confirmation of consent and the provision of passport data to determine the true age of the User.
6.14. Responsibility for the purchase of Additional Paid Services rests entirely with the User and their legal representatives.
6.15. Disputes about responsibility for the purchase of Additional Paid Services with the Portal Operator are inadmissible.
6.16. Receiving additional Paid Services by the user is possible only after full payment of their cost.
7. Disclaimer of Warranties
ALL SERVICES ON THE PORTAL ARE PROVIDED TO USERS ACCORDING TO THE ESTABLISHED CONCEPT OF “AS IS”. THE PORTAL DISCLAIMS ANY WARRANTIES REGARDING SERVICES OR VIRTUAL ASSETS.
THE OPERATOR HEREBY WARNS AND REMINDS THAT EXCESSIVE USE OF PCS, INCLUDING PC GAMES, CAN HARM THE USER'S HEALTH. THE USER OR THEIR LEGAL REPRESENTATIVES AGREE TO INDEPENDENTLY MONITOR THE STATE OF HEALTH AND NOT USE SERVICES / LIMIT THEIR USE IF THERE ARE ANY CONTRAINDICATIONS.
THE OPERATOR IS NOT RESPONSIBLE FOR ANY INDIRECT, INCIDENTAL, OR OTHER DAMAGES (INCLUDING, BUT NOT LIMITED TO, LOST PROFITS) RESULTING FROM THE GAMING SERVICES, PORTAL SITES AND / OR MATERIALS ON THE SITE, ACTIONS OF THIRD PARTIES RELATED TO THE OPERATOR'S SERVICES AND PORTAL AND / OR MATERIALS ON THE SITE, INCLUDING FRAUDULENT AND / OR NEGLIGENT ACTIONS OF THIRD PARTIES.
8. Additional Provisions
8.1. If the User does not have the right to use the Portal according to the legislation of their country or there are other restrictions (age access and others), they must, without warning, refuse to use the Portal, as well as its individual services. The User takes full responsibility for using the Portal in their country, based on local laws and considering international legislation.
8.2. The invalidity of one/several clauses/sections of the User Agreement does not entail its invalidity as a whole. In this case, the parties must fulfill the obligations under the remaining clauses/sections of the Agreement.
8.3. Disputes arising between the parties are subject to initial resolution in a pre-trial procedure, through correspondence between the Operator and the User. In case of ineffective mediation resolution of disputes, they will be resolved in accordance with the legislation of the Republic of Latvia.
8.4. This Agreement may be amended, supplemented by the Operator without prior notice to the User. Any changes take effect immediately after the publication of the amended version of the Agreement on the Site. To avoid disputes, the User undertakes to independently check the text of the Agreement on the Site, where it is freely available. If the User fails to check the text of the Agreement, this fact cannot be a basis for refusing to fulfill the obligations assumed. The amended version of the Agreement after publication on the Site has the same legal force as the original text.
In accordance with this section, the Operator is not liable for:
Any damage caused or that may only be caused to the User's personal data and computer in connection with the use of the Portal and Site.
Losses (direct/indirect) incurred by the User in connection with the use or unavailability of the Portal (inability to use them), the behavior of third parties on the Portal, as well as other participants in the Portal's projects, unauthorized access to the User's personal data.
Statements, disseminated information, statements by the User, and other unlawful actions committed by them on the Portal and beyond.
The User-provided information at registration, loss of access to the Portal (login, password, etc.).
Loss by the User of virtual assets acquired as a result of the provision of Services and Additional Paid Services by the Operator.
Payment by the User of Additional Paid Services and related expenses.
Continuous operation of the Portal.
User's capabilities related to Internet access, data transfer speed.
4.7. Operator does not guarantee:
Continuous, reliable, error-free operation of the Portal, access to its resources, Services, including Additional Paid Services.
That the Portal will fully meet the User's requirements and expectations.
That the quality of the Services provided (Additional Paid Services) will meet the User's expectations.
The Operator is not obliged, upon the User's request, to provide documents and other evidence proving the User's violation of this Agreement and the imposition of punitive/disciplinary sanctions against them.
The User uses the Portal, the Operator's Site solely at their own risk, voluntarily, without coercion. They understand the potential risks associated with using the Operator's resources and have no claims of a material nature against the Operator.
5. Confidentiality and Security
5.1. Confidential information - information obtained by the Operator during the User's registration on the Site, as well as during visits to the Sites/Portal and participation in Portal events.
5.2. Confidential information is not subject to disclosure or transfer to third parties.
5.3. Personal data may be transferred by the Operator only in the following cases:
Official request from law enforcement authorities (violation of local and international laws).
User's personal expression of will.
Impossibility to use Services and Additional Paid Services on the Portals (of which the User is warned in advance).
Violation of the terms of this Agreement (at the discretion of the Operator).
5.4. The Operator ensures the security of the user's personal data using special software. In case of unauthorized access to the Portal/Site by third parties, the security of personal data is not guaranteed.
6. Additional Paid Services
6.1. At the request of the User, the operator provides Additional Paid Services. These allow the use of extended features of the Portal.
6.2. Additional Paid Services are not a mandatory condition for using the Portal and participating in the Portal projects.
6.3. From the moment the funds are debited by the Portal Operator from the User's account, the Additional Paid Service is considered to be provided in full and of proper quality.
6.4. After the provision of an Additional Paid Service, the money spent on its purchase is not refundable.
6.5. The User agrees that the Operator has the right to store personal information received when purchasing Additional Paid Services.
6.6. The list of Additional Paid Services and their cost are published only by the Operator on the Site/Portal. Any information and offers to purchase these services on third-party resources are considered fraudulent, for which the Operator is not responsible.
6.7. The methods and possibility of purchasing Additional Paid Services are explained by the Operator on the Site.
6.8. The Operator does not provide explanations on working with payment systems that the User decided to use to purchase Additional Paid Services, nor is it responsible for their correct operation.
6.9. In the case of technical malfunction of the Sites or intentional actions by the User, as well as in other cases when Additional Paid Services were provided without full/partial debiting of funds from the User's account, the User is obliged to inform the Operator about this fact. After that, the User must repay the resulting debt.
6.10. The Operator does not reimburse the User for unused (partially used) Additional Paid Services.
6.11. The User independently bears all financial expenses associated with the acquisition (transfer of money) of Additional Paid Services. This section includes: commissions, fees, and other expenses.
6.12. The User guarantees to the Operator that they have all legal powers and rights to conclude this Agreement regarding Additional Paid Services.
6.13. If Additional Paid Services are purchased by a User under the age of 18, they must first obtain consent for the financial transaction from their legal representatives. The fact of purchasing Additional Paid Services confirms that such consent has been obtained from the legal representative. If necessary, the Operator has the right to request written confirmation of consent and the provision of passport data to determine the true age of the User.
6.14. Responsibility for the purchase of Additional Paid Services rests entirely with the User and their legal representatives.
6.15. Disputes about responsibility for the purchase of Additional Paid Services with the Portal Operator are inadmissible.
6.16. Receiving additional Paid Services by the user is possible only after full payment of their cost.
7. Disclaimer of Warranties
ALL SERVICES ON THE PORTAL ARE PROVIDED TO USERS ACCORDING TO THE ESTABLISHED CONCEPT OF “AS IS”. THE PORTAL DISCLAIMS ANY WARRANTIES REGARDING SERVICES OR VIRTUAL ASSETS.
THE OPERATOR HEREBY WARNS AND REMINDS THAT EXCESSIVE USE OF PCS, INCLUDING PC GAMES, CAN HARM THE USER'S HEALTH. THE USER OR THEIR LEGAL REPRESENTATIVES AGREE TO INDEPENDENTLY MONITOR THE STATE OF HEALTH AND NOT USE SERVICES / LIMIT THEIR USE IF THERE ARE ANY CONTRAINDICATIONS.
THE OPERATOR IS NOT RESPONSIBLE FOR ANY INDIRECT, INCIDENTAL, OR OTHER DAMAGES (INCLUDING, BUT NOT LIMITED TO, LOST PROFITS) RESULTING FROM THE GAMING SERVICES, PORTAL SITES AND / OR MATERIALS ON THE SITE, ACTIONS OF THIRD PARTIES RELATED TO THE OPERATOR'S SERVICES AND PORTAL AND / OR MATERIALS ON THE SITE, INCLUDING FRAUDULENT AND / OR NEGLIGENT ACTIONS OF THIRD PARTIES.
8. Additional Provisions
8.1. If the User does not have the right to use the Portal according to the legislation of their country or there are other restrictions (age access and others), they must, without warning, refuse to use the Portal, as well as its individual services. The User takes full responsibility for using the Portal in their country, based on local laws and considering international legislation.
8.2. The invalidity of one/several clauses/sections of the User Agreement does not entail its invalidity as a whole. In this case, the parties must fulfill the obligations under the remaining clauses/sections of the Agreement.
8.3. Disputes arising between the parties are subject to initial resolution in a pre-trial procedure, through correspondence between the Operator and the User. In case of ineffective mediation resolution of disputes, they will be resolved in accordance with the legislation of the Republic of Latvia.
8.4. This Agreement may be amended, supplemented by the Operator without prior notice to the User. Any changes take effect immediately after the publication of the amended version of the Agreement on the Site. To avoid disputes, the User undertakes to independently check the text of the Agreement on the Site, where it is freely available. If the User fails to check the text of the Agreement, this fact cannot be a basis for refusing to fulfill the obligations assumed. The amended version of the Agreement after publication on the Site has the same legal force as the original text.
